Who these terms are between

These terms govern your use of wispit, operated by Wispit UG (haftungsbeschränkt), 10115 Berlin, Germany. Full company details are in the imprint. wispit is offered to businesses and self-employed people acting in a professional capacity.

The service

Within your niche, wispit researches publicly available social media content, generates insights, scripts, and videos for your brand, and learns from the performance of what you publish.

Your content

You own the content wispit generates for your brand: insights, scripts, and videos. You are responsible for what you publish and for complying with the terms of the platforms you publish to. You grant us the rights needed to process your inputs in order to provide the service.

AI-generated content

Output is generated by AI systems and can be inaccurate. Review it before you publish. Where the law requires that synthetic media be disclosed or labelled as artificially generated, including under Article 50 of Regulation (EU) 2024/1689, that duty falls on you as the publisher. wispit provides disclosure tooling to help you meet it.

Fair use

Research is limited to publicly available posts and metrics. You agree not to use wispit to harass, impersonate, or misrepresent competitors or any third party, to generate unlawful or infringing content, or to circumvent the technical limits of your plan.

Billing

Paid plans are billed monthly in advance and can be cancelled anytime, effective at the end of the billing period. The free analysis requires no payment method. Prices are stated exclusive of VAT unless marked otherwise. We may change prices for future billing periods and will give you at least 30 days notice before a change takes effect.

Term and termination

The agreement runs for the billing period you selected and renews unless cancelled. You can cancel from your account settings. Either party may terminate for good cause. We may suspend an account that breaches these terms, and will tell you why where we are permitted to.

Consumers and the right of withdrawal

wispit is directed at businesses and is not currently offered to consumers. If that changes, this section will be updated with the full statutory withdrawal instruction and model withdrawal form before consumer sales begin.

Availability

We work to keep wispit available but do not promise uninterrupted service. Maintenance, third-party platform changes, and rate limits at the sources we research can all interrupt parts of the pipeline.

Data protection

How we handle personal data is set out in the privacy policy. Where we process personal data on your behalf, a data processing agreement under Art. 28 GDPR applies; request it at [email protected]. On request under that agreement, we provide a named list of the subprocessors we use and their location, and will give notice before adding or replacing one so you have the chance to object on reasonable data protection grounds.

Liability

Recommendations from wispit are based on public data; publishing decisions remain yours. Service is provided without warranty of specific performance outcomes. We are liable without limit for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

Changes to these terms

We may update these terms. We will notify you of material changes at least 30 days before they take effect, and you may cancel before then if you do not accept them.

Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Berlin, Germany. Mandatory consumer protection law of your country of residence remains unaffected.
